Genealogy for Cemetery Compliance Law

CEMETERY PROJECTS - What the Law Requires:

If graves are to be disturbed due to development or other reasons, the Georgia Code requires that a permit be obtained from the city or county where the cemetery is located. According to Ga Code 36-72-5, the permit application must include:

1. Proof of title to the land

2. Archaeologist's report giving number & locations of graves

3. Survey prepared by registered surveyor showing location & boundaries of cemetery

4. Plan by professional genealogist for identifying & notifying living descendants

5. Proposal for limiting or avoiding effects of cemetery project.
